If you do not agree with these Terms, please discontinue use of the website.Separate terms, agreements, waivers, or policies may apply if you enroll in Arizyn coaching services.

1. ELIGIBILITY

Arizyn's website and coaching services are intended for individuals age 18 and older.By applying for or purchasing coaching services, you represent that you are at least 18 years old and legally capable of entering into an agreement.

2. WEBSITE PURPOSE

Arizyn provides educational information related to fitness, exercise, nutrition, habits, wellness, lifestyle, and personal development.Website content is provided for general informational and educational purposes.Information presented on the website should not be interpreted as individualized medical advice, diagnosis, treatment, rehabilitation, mental health treatment, or other licensed healthcare services.

3. FITNESS AND NUTRITION DISCLAIMER

Exercise and changes to nutrition involve individual considerations and may not be appropriate for every person.You are responsible for determining whether participation in an exercise, nutrition, or wellness activity is appropriate for you.You should consult an appropriate licensed healthcare professional before beginning or modifying an exercise or nutrition program when you have questions or concerns regarding your health, medical conditions, injuries, medications, pregnancy, symptoms, or ability to safely participate.Arizyn does not diagnose, treat, cure, or prevent medical conditions.Nutrition coaching provided by Arizyn is educational in nature and is not medical nutrition therapy or a substitute for individualized care from a physician, registered dietitian, or other appropriately licensed healthcare professional.

4. PARAMEDIC AND PROFESSIONAL CREDENTIALS

Arizyn's founder may publicly identify professional credentials and experience, including experience as a paramedic and certification as a NASM Certified Nutrition Coach.References to these credentials are provided to accurately describe professional background and experience.Use of the Arizyn website or participation in Arizyn fitness or nutrition coaching does not establish a paramedic-patient, physician-patient, therapist-patient, dietitian-patient, or other medical provider-patient relationship.Arizyn coaching is separate from emergency medical services and individualized medical treatment.

5. EMERGENCIES

Arizyn coaching communication is not an emergency service.Messages, email, coaching applications, and coaching-platform communications are not continuously monitored and should not be used to seek emergency assistance.
Arizyn may provide general response-time expectations to coaching clients, but those expectations do not constitute emergency or on-demand availability.If you believe you are experiencing a medical, mental health, or other emergency, seek appropriate emergency assistance rather than waiting for a response from Arizyn.

6. ASSUMPTION OF RISK

Physical exercise and fitness activities involve inherent risks, including the possibility of injury.By choosing to participate in exercise or other activities discussed through Arizyn content or services, you acknowledge that you are voluntarily participating and accept the risks associated with those activities.You are responsible for exercising appropriate judgment regarding your physical capabilities, surroundings, equipment, and health status.Participation in paid coaching may also be subject to a separate informed consent, waiver, assumption-of-risk agreement, or coaching agreement.

7. NO GUARANTEE OF RESULTS

Individual results vary.Arizyn does not guarantee any specific amount or rate of:

  • Weight loss

  • Weight gain

  • Muscle growth

  • Strength development

  • Body composition change

  • Athletic performance

  • Health improvement

  • Habit change

  • Competition outcome

  • Or other result

Results depend on numerous individual factors, including consistency, adherence, experience, physiology, lifestyle, nutrition, recovery, health status, and circumstances outside Arizyn's control.Testimonials, photographs, transformations, competition results, and other examples represent individual experiences and are not guarantees that another person will achieve the same or similar results.

8. COACHING SERVICES

Information on this website describing coaching packages, features, pricing, availability, or services is provided for informational purposes.Enrollment in coaching may require acceptance of a separate Client Coaching Agreement, informed consent, waiver, payment authorization, or other documents.Those agreements may contain additional terms governing matters such as:

  • Minimum coaching periods

  • Recurring billing

  • Payment obligations

  • Cancellation

  • Refunds

  • Communication

  • Coaching calls

  • Client responsibilities

  • Program delivery

  • Termination

  • Assumption of risk

If a separate written coaching agreement conflicts with these general website Terms regarding the coaching relationship, the applicable coaching agreement will control to the extent of that conflict.

9. PAYMENTS

Certain Arizyn services require payment.Pricing, billing frequency, minimum commitments, renewal terms, cancellation requirements, and refund policies applicable to coaching will be disclosed through the applicable offer and/or Client Coaching Agreement before enrollment.Payments may be processed by third-party payment providers.
You are responsible for reviewing and understanding the applicable payment terms before completing a purchase.

10. INTELLECTUAL PROPERTY

Unless otherwise stated, Arizyn's website and original materials are owned by or licensed to ARIZYN LLC and are protected by applicable intellectual property laws.This includes, where applicable:

  • The Arizyn name and branding

  • Logos

  • Written website content

  • Graphics

  • Photographs and videos

  • Educational materials

  • Training resources

  • Program materials

  • Guides

  • Worksheets

  • Downloads

  • Coaching resources

  • Original social media content

You may view and use publicly available Arizyn content for your own personal, noncommercial purposes.You may share publicly available educational Arizyn content online when Arizyn remains clearly identified as the source and appropriate credit or tagging is provided.You may not, without written permission:

  • Claim Arizyn content as your own

  • Remove branding or attribution for the purpose of representing the material as your own

  • Reproduce substantial portions of Arizyn materials as your own content

  • Sell, license, sublicense, or commercially distribute Arizyn materials

  • Repackage Arizyn materials into another product, program, course, or coaching service

  • Distribute individualized training programs or client-only resources to others

  • Modify Arizyn materials in a misleading manner

  • Use Arizyn intellectual property in a way that suggests an affiliation, endorsement, or partnership that does not exist

13. TESTIMONIALS AND CLIENT CONTENT

Testimonials, photographs, progress information, and client experiences displayed by Arizyn are intended to illustrate individual experiences.They are not promises or guarantees of future results.Arizyn will seek appropriate permission before intentionally using identifiable client photographs, testimonials, progress information, or similar client content for marketing purposes.

14. WEBSITE AVAILABILITY AND ACCURACY

We make reasonable efforts to keep information accurate and current, but we do not guarantee that all website content will always be complete, error-free, or current.Services, pricing, features, availability, and website content may change.We may modify, suspend, or discontinue website features or content at any time.

15. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the Arizyn website and general website content are provided on an "as is" and "as available" basis.We do not make warranties that the website will always be uninterrupted, error-free, completely secure, or suitable for every individual purpose.Nothing in these Terms excludes any warranty or consumer right that cannot legally be excluded.

17. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless ARIZYN LLC and its owners, team members, contractors, and representatives from claims, losses, liabilities, or expenses arising from your unlawful misuse of the website, violation of these Terms, or infringement of another person's rights.This provision does not require you to indemnify Arizyn for conduct for which indemnification cannot legally be required.

18. TERMINATION OR RESTRICTION OF ACCESS

We may restrict or terminate access to our website or services where reasonably necessary because of misuse, unlawful conduct, violation of applicable agreements, threats to safety or security, nonpayment where applicable, or other material violations.Termination of paid coaching services is governed primarily by the applicable Client Coaching Agreement.

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles, except where applicable law requires otherwise.Nothing in these Terms is intended to waive rights or protections that cannot legally be waived.

20. CHANGES TO THESE TERMS

We may update these Terms periodically to reflect changes to our website, services, business practices, or applicable requirements.Updated Terms will be posted with a revised effective date.Your continued use of the website after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.

21. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
